When playing on a public playground that is maintained by a municipality there is some risk of injury. This was the case for an unidentified minor who was playing on a playground in Westport when she fell from a tire swing and was injured. Public playgrounds that are maintained by municipalities may leave a minor injured and the community open to liability.
If your child is playing on a playground and is injured you may have a case of a New Haven personal injury.
In the case of the unidentified minor who was injured in Westport the damages that the family is seeking on her behalf are monetary and those being sought include;
- leg pain and injury
- laceration of the leg which required stitches
- mental and physical pain and suffering
- the loss of the young girl to pursue her life’s interests
While the case has not yet heard, it is important to note that in many cases there is liability on the part of the municipality, especially if they are found to have been negligent in repairs to a particular piece of playground equipment, if they knowingly let a piece of equipment fall into disrepair which led to the injury, or they failed to supervise the child properly while he/she was on the equipment.
